View Full Version : How would I go about getting papers drafted for a sort of living will?

My dad wants me to draft something that states that I'll have partial ownership of our home, and upon his passing, I and my mother will own an equal percentage. I know he wants me to do this because of some irrational superstitious fear that men, especially black men have that they'll drop dead the moment they finish writing their will, and that annoys me. This should be his task. Anyway, how would I go about this?

He probably needs to get a lawyer. Or it might be in the writing of owning the house who will own it/take over payments in the event of current owner's death.

If that clause is in the home's contract then it should be a matter of signatures (yours and your parents).

I just had my will done this past year. Did it through a lawyer and it was actually a pretty lengthy process, though it also included trust fund, power of attorney, who gets custody of my son, etc.

Thought about doing it online through one of the many online will services to save some money (a lot of money) but I heard they are not as airtight as going through a real lawyer, so I bit the bullet. I wanted there to be absolutely no question to who gets custody of my son and that the money would go to him (after he turns 21 of course). Plus with a real person, you can ask as many questions as you like if you don't understand what is going on.

Because you are doing it for your dad, the online will route may be something you want to look at, mostly because you will be answering all the questions and such online for him. At the end, he would just be the one signing everything (it would need to be notarized). A lawyer would want your dad to be the one answering these questions. But like I said, I heard these aren't as airtight. If you have some falling out with your mom, she could take you to court over the will to get the entire house.

Btw, not sure if this would effect a mortgage, but having your name on the deed of a home (even for partial ownership) would probably make you responsible for the property taxes as well. Property taxes suck.

You actually don't need a lawyer. My office I work for does living trusts (that include wills). The fee is usually based upon the value of your assets.

oh is it? in the show himym....baney's catchphrase has always been "suit up"..cuz he wears a suit to pick up chicks. but when one of the characters passes the bar, he says.."laywer up"...assumed it was a reference to that.
